The best time to plan your estate strategy is when you don't need it. Unfortunately, too many people wait until a crisis (illness, death, incapacity) to have the difficult conversations about what happens to their things (assets) or loved ones (children, spouse, pets). Failing to plan important instructions and protect assets prior to a crisis too often leads to family disputes, costly legal fees, and wasted time with court proceedings. Planning ahead gives you and your loved ones the peace of mind you deserve. Depending on the size of your estate and number/age of your beneficiaries, we provide comprehensive Estate Planning documents that can include Wills, Trusts, Transfer on Death Deeds, Powers of Attorney, Health Care Directives, Nominations for Guardians, Special Needs Trusts, Funding Instructions, Personal Property Memorandums and more.
Probate and Estate Administration focuses on becoming appointed Personal Representative or Executor after a loved one’s (lawyer talk "Decedent's") death. If the Decedent had a Will, then the Personal Representative must Probate (literally meaning to "prove") the Will and distribute assets according to the Will. Where there is no Will, the Personal Representative must proceed with estate administration through judicial process and distribute assets according to state laws of intestacy (lawyer talk for dying without a Will). We can help you become the Personal Representative, prepare Petitions for Probate, assist you with obtaining Letters of Administration, and walk you through estate administration step-by-step.
When an individual is unable to make decisions for herself the Court can give a person or organization the right to make decisions on behalf of, and for the best interest of the individual. Whether serving as counsel for the subject (individual that may need a guardian) or assisting you to petition for guardianship for a loved one, the process will be explained each step of the way in a language you can understand. My team also services the needs of the growing aging population and helps navigate Medicaid, SSA, and other government benefits.
